Protecting Pets in Abuse Cases: New Legal Protections for Companion Animals

Filing a Petition for Protection from Abuse (PFA) is an incredibly challenging and emotionally taxing process. It often involves navigating complex legal procedures while also managing the overwhelming stress of an abusive situation. For those who are unfamiliar with the process, I encourage you to explore my previous blogs that offer insight into what a PFA is and how the process works.

However, when domestic violence involves a beloved pet, the emotional burden can be even more overwhelming. Many individuals in abusive situations are deeply concerned not only for their own safety but also for the well-being of their animals. Animal abuse often accompanies domestic violence, and the fear of leaving a pet behind or the possibility of an abuser harming the pet can prevent victims from seeking help or escaping the dangerous environment.

Recognizing this critical issue, the Protection from Abuse Act was amended to offer new legal relief for those with pets caught in abusive situations. Effective January 17, 2025, the amendment allows individuals filing a Petition for Protection from Abuse to request temporary ownership rights over their companion animals. In addition, the PFA can include provisions that require the abuser to refrain from possessing, contacting, transferring, or relocating the pet, or even entering the property where the animal is being sheltered.

This significant change ensures that pets—defined as companion animals—are afforded the same protections as individuals. The law now allows for their safety and well-being to be prioritized in situations where abuse is present, removing them from potential harm at the hands of an abuser. Importantly, a “companion animal” is defined as any animal not used in commercial agriculture, which is owned, kept, leased, or possessed by the petitioner, respondent, or a minor child of either.
